I can't drive 0.05

As per usual, Dalton McGuinty has yet again stepped up to the plate and hit the ball way out to left field, way way out. This time, the Ontario government has decided that even though the legal blood alcohol content level is 0.08 as per the criminal code of Canada, anyone caught with levels between 0.05-0.08 will now be considered to have broken the law and will be given a 3 day license suspension, even if it is your first offence. The kicker is that a person will not be able to appeal the decision made by the police officer who happens to stop you. No due process, none. If caught with a similar level of booze in their system a second time, their licence will then be suspended for 7 days and the driver will have to attend an alcohol education program. A third time will get you a 30 day suspension complete with the remedial alcohol treatment program and an ignition interlock condition placed on your licence for six months. Previously, drivers received only a 12-hour licence suspension for blowing a blood alcohol level between 0.05 and 0.08, no matter how many times they were caught. Keep in mind folks, this is for those caught below the so called legal limit, so it seems there are now two legal limits which makes no sense but more about that later.

Follow up:

These suspensions will remain on your record and could affect your insurance rates and there isn't a damn thing you can do about it. Not only that, the quality and reliability of roadside breathalyzers has been questioned in court many times, but none of that matters now because the police are now the judge and jury and can levy a charge against you and you can do nothing about it. Roadside trials are now going to be the norm and the police have gained an even greater amount of authority. Those blowing .05-.08 have no due process, whereas those blowing over the legal limit have the right to defend themselves in a court of law. Does anyone not see that this is totally fucked up? Punishment is being vetted out against those who did not break the law,they only got caught in the so called "warn zone" and we as Ontarians will sit here and take it like the bitches we are because Dalton and his gang knows best.

I am not an advocate for drinking and driving but when laws like this are enacted, and you get punished for doing something that isn't even breaking the real law, then I am left scratching my nuts in disbelief. Either you are impaired and should be dealt with accordingly, or you are not, so how they can punish you for not being impaired is something I fail to grasp. There is no partially guilty as far as I know and so I think this law needs to be challenged in court because it doesn't make any sense at all.
